Terms and Conditions

All orders placed with Bubbles and Butterflies are subject to the following terms and conditions. Continuing with your order means you have read and agree to the following.

Completion of an order form and payment for any goods ordered from Bubbles and Butterflies enters the customer into a contract and provides conclusive evidence that the customer agrees to these terms and conditions. 

Bubbles and Butterflies reserve the right to update/amend these terms and conditions at anytime, the customer is bound to any such changes.

Pricing, Product Descriptions & Availability

All prices displayed on this website are in Pounds Sterling and inclusive of VAT and exclusive of packing and delivery. Where images show complete party bags and party bag contents, this is for illustration purposes only. One party bag consists of one set of contents as described in the text. Some individual items come in ranges like animals or in different colours. We will select one at random and you may not receive the same item as illustrated in the picture. Our item descriptions always state this where applicable. Where sizes of products are quoted these are only intended as a guide. Prices and availability are subject to change without notice. All products shown on the website should be in stock. In the unlikely event that items ordered are out of stock we will inform you by e-mail or telephone offering you an alternative, a new delivery date or an opportunity to cancel the order. Price and availability information is subject to change without notice.

Delivery Prices

A Royal Mail 2nd Class delivery charge of £3.95, Royal Mail 1st Class delivery charge of £5.95 or Courier delivery charge of £6.99 for mainland UK will be set against each order and will be taken at the time of checkout. Please contact us for delivery charges outside of the UK mainland.

Delivery of Goods

We endeavour to dispatch all orders within 2 working days. Please allow 3-5 working days for delivery. Orders paid by cheque or postal order require clearance of funds before goods will be dispatched. 

Delivery is via Royal Mail and subject to their normal terms and conditions. Please note we cannot take responsibility for industrial action taken by Royal Mail or any other unforeseeable circumstance resulting in a delay in the delivery of your item. We recommend our new Courier option for a more guaranteed service.

Bubbles and Butterflies reserve the right to deliver goods in part. 

Delivery of goods constitutes fulfilment of order. 

Health and Safety

All toys featured within the pre-filled party bags and sold as separate items comply with the European Toy Safety Regulations and where appropriate bear the CE Mark. Should an item be unsuitable for children under 3 years, usually because of small parts, this will be specified in the description of the item. It is the customer’s responsibility to check the suitability of these items for the age of the children for whom you are purchasing. Some sweet treats, chosen as an option with our party bags, can be a choking hazard and we cannot guarantee that our sweets are nut free.

The bags supplied by Bubbles and Butterflies either empty or pre-filled are unsuitable for children under the age of 36 months due to, but not limited to, the risk of suffocation. Bubbles and Butterflies does not accept liability for any injury, damage or loss which occurs due to the bag or its contents, getting into the hands of a child under the age of 36 months. It is the responsibility of the customer to ensure that the distribution of all bags to children under 36 months is with the full consent and supervision of a responsible adult. Customers should further ensure that our party bags are not given to anyone who may have an allergy or any other specific condition, which may make the party bag or its contents unsuitable or harmful to them. Bubbles and Butterflies does not accept liability for any injury, damage or loss that may occur due to our party bags having been given to anyone for whom they were unsuitable, as detailed above.

Cancellation

If the customer is unhappy with the products ordered, in full or part, they can be returned within 14 days of receipt. Returned goods must be in good condition and include any promotional products received. Customers must include a covering note explaining reasons for the return. This does not affect your statutory rights.

Bubbles and Butterflies advises customers to use special delivery and that proof of postage is retained. It will be the customer’s responsibility to pay the return postage, except in cases of faulty, damaged or wrongly supplied goods. 

Loss or Damage

Bubbles and Butterflies responsibility for lost or damaged goods whilst in transit, is limited to replacement or refunds of the items, at the customer’s choice.

Bubbles and Butterflies hereby, to the fullest extent permitted by law, disclaims all warranties and conditions with regard to the material and any goods and services supplied in relation to this website, whether expressed or implied or statutory (including all implied warranties and conditions of the merchant ability and fitness for a particular purpose). In no event that Bubbles and Butterflies be liable for any indirect, punitive, special, incidental or consequential damages or loss whatsoever even if Bubbles and Butterflies has been advised of the possibility of damages including, without limitation, damages for loss of use, data or profits arising out of or in any way connected with the use or performance of this website, interruptions or delays to this website, the provision of or failing to provide services, or for any information, material, goods and services obtain through this website or otherwise arising out of the use of this website, whether based on contract, or otherwise to the fullest extent permitted by law.
